This warranty applies to diesel engine component parts which are remanufactured or sold by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC. All products remanufactured or sold by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., are warranted to be free from defects in material and workmanship for a period of One Hundred Eighty (180) days from the date of sale to user. This warranty covers any failure of a part or parts which results, under normal use, service, and proper maintenance from defects in workmanship or materials.

All parts submitted for warranty adjustment must be returned "FREIGHT PREPAID^" to DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC. No warranty claims will be considered without return of the parts and all necessary or related parts. The parts must be returned in the condition in which they were removed from the engine and must include all parts necessary for the functioning of the parts in a normal manner. (e.g., In the case of a cylinder head, it must be returned to the factory uncleaned and without removal of valves, springs and pre-combustion chambers and all associated parts. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., retains the right to request additional information concerning the claim, the use of the parts, and the circumstances of their alleged failure. The claim information concerning the alleged failure must be submitted upon a claim form provided by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., and said form must be completed in full and submitted with the part in order for any or all warranty claims to be considered.

DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., shall repair or replace, with a remanufactured part or parts, any part or parts which it determines to be defective at the time of shipment. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., may in its sole discretion, adjust for reasonable labor charges should DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., determine that this remedy is appropriate. If a request for related parts and labor credit is submitted, it must reflect dealer or distributor net costs. Claims submitted bearing prices other than dealer net will be returned for adjustment. Labor costs for part removal, repair and reinstallation will not be considered for customer or ultimate consumer installed components. Further, no adjustment will be made for labor costs for part removal, repair and installation for items sold "over-the-counter". Labor claims will be considered only on dealer-installed components.

All related labor will be charged at standard regular time rates. No overtime charges will be allowed unless such charges are pre-approved by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC.

DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., or the dealers or distributors for said DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., shall not be liable for any failure or parts due to improper installation, inadequate maintenance, abuse, accident, misuse, misapplication, storage, damage, negligence or modification of any part or component supplied by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC. shall not be liable for damages caused by failure of any component supplied by any other supplier of parts or any other component attached to the engine or to parts supplied by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC.

DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., will conduct a warranty claim investigation upon receipt of the said claim form and all necessary parts. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., will contact you with the result of their inspection at the earliest possible time. Certain types of testing and analysis require considerable periods of time to perform. At such time as results are available, then the claim will be adjusted.

This warranty does not cover any economic loss, including without limitation, communication expenses, towing, mechanic's travel, time and/or mileage, meals, lodging, loss or use of the engine or equipment, loss of time, inconvenience, cargo damage, overtime or any other cost of expense resulting from a defect covered by this warranty.

This warranty is the only warranty applicable to parts remanufactured by DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., and is in lieu of any other warranties express or implied, including any implied warranty of merchantability or fitness for a particular purpose. The performance of repairs is the exclusive remedy under this warranty. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., does not authorize any person to assume or create for it any other obligation or liability in connection with DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., components. DIESEL HEAD & PARTS, INC or DIESEL HEAD & PARTS SERVICE, INC., shall not be liable for incidental or consequential damages resulting from breach of this written warranty or any implied warranty.
